Um olhar feminista na interpretação constitucional: abordagem analítica sobre a influência do feminismo na construção da igualdade de gênero

Abstract

This dissertation aims to assess the principle of equality in the Federal Constitution from a feminist perspective, in order to consider whether it is actually possible to speak of equality in a material way. In this sense, it is imperative to evaluate what material equality is. The research starts from the analysis and history of the emergence of Feminism, of the women who contributed to the various changes promoted in the social and political environment. In addition, it includes a historical overview of how the first women's movements emerged in search of their rights and the beginnings of feminism. It also includes the necessary analysis of the events prior to the military dictatorship, which culminated in the period of the Constituent Assembly. This period is a legal milestone in the legal sphere of positive rights for women. In the current Brazilian situation, the mechanisms that were decisive for women to seek their voice and the struggles necessary for them to be heard and represented are presented. There is an analysis of current feminist movements and the increased representation of women in society in the search for the defense of their rights. This study instigates the search for tools that encourage and lead to the understanding of the need for a strengthened and respected Federal Constitution so that the rights women have won, more than just enshrined, are effectively applied. The work is of a bibliographic nature, based on classical and contemporary theorists, and, through the deductive method, seeks to use the principle of equality from a feminist perspective, in order to elucidate the strength of women and their inclusion in the Federal Constitution.
