???metadata.dc.description.resumo???: Os direitos fundamentais, como conquistas da humanidade, surgiram de forma lenta e gradual com o advento da Modernidade, que permitiu a positivação nos ordenamentos jurídicos nacionais e internacionais. Entretanto, em que pese tal positivação, a implementação deles, em especial os sociais, tem sido difícil, tendo em conta o credo neoliberal que supervaloriza o princípio da liberdade, em detrimento do princípio da igualdade. Então, como enfrentamento de tal questão, impõe-se uma conciliação dos princípios da liberdade e da igualdade, bem como o resgate do princípio da fraternidade (solidariedade), o que somente é possível com uma reconstrução democrática, garantista, participativa e inclusiva dos direitos fundamentais sociais, a fim de que sejam favorecidos os mais vulneráveis e que necessitam de inclusão social. Para isso, impõe-se uma nova compreensão da própria democracia contemporânea, porquanto ainda marcadamente elitista e restrita, ao privilegiar o mercado e a economia na tomada das decisões políticas do governo, relegando-as aos técnicos em nome de uma eficiência econômica. Essa concepção também era sustentada pela teoria das elites, que amparava a democracia elitista, na qual apenas a elite poderia participar do governo, tendo em conta que as massas não sabiam de política. Igualmente, a visão restrita da democracia vinculava a democracia às eleições, como sendo a forma de participação, limitando-a uma competição dos votos do eleitor. Em razão disso, decorrente desse alijamento da participação e da própria política, a teoria econômica da democracia, respaldada pela análise econômica do direito, numa visão marginalista e neoliberal da economia, desprovida de conteúdo ético e embasada no homo oeconomicus, passa a ditar o modelo da democracia contemporânea, na qual as decisões governamentais devem seguir os ditames da economia e do mercado, implicando em risco aos direitos fundamentais, na medida em que estes deixam de ser concretizados, em nome de uma eficiência econômica. Essa modalidade de democracia, propalada pelo atual governo brasileiro, como de democracia da eficiência, restou implementada, na prática, com a promulgação da Emenda Constitucional 95/2016, ao instituir um congelamento, por 20 anos, dos investimentos em áreas sociais, como saúde, educação e assistência social, como forma de contingenciamento dos gastos públicos, com a adoção de um rigoroso ajuste fiscal. Tais medidas, por refletirem na concretização de direitos fundamentais sociais, estando estes incluídos como cláusulas pétreas, na norma do art. 60, § 4º, IV, da Constituição Federal, implicam em violação às referidas cláusulas, bem como impõem evidente retrocesso social, em evidente violação ao princípio da proibição do retrocesso social, reconhecido implicitamente pelo ordenamento constitucional brasileiro. Por isso, como enfrentamento deste retrocesso implementado pela Emenda referida, é preciso que haja uma interpretação constitucional comprometida com a identidade constitucional, que é de garantidora dos direitos fundamentais, inclusive os sociais, os quais devem ser colocados na esfera do indecidível, a salvo de maiorias eventuais, impedindo que sejam atingidos, sob pena de inconstitucionalidade.
Abstract: Fundamental rights, like the achievements of humanity, have emerged slowly and gradually with the advent of Modernity, which has allowed for a positive change in national and international legal systems. However, in spite of such positivation, the implementation of them, especially the social ones, has been difficult, taking into account the neoliberal creed that overvalues the principle of freedom, to the detriment of the principle of equality. So, in order to confront this question, there is a need to reconcile the principles of freedom and equality, as well as to rescue the principle of fraternity (solidarity), which can only be achieved through democratic, guaranteeing, participatory and inclusive rights reconstruction. fundamental rights, so that the most vulnerable and those in need of social inclusion are favored. In order to do so, a new understanding of contemporary democracy is required, since it is still markedly elitist and restricted, by privileging the market and the economy in the political decisions of the government, relegating them to the technicians in the name of economic efficiency. This view was also supported by the theory of elites, which supported elite democracy, in which only the elite could participate in government, given that the masses did not know politics. Likewise, the narrow view of democracy linked democracy to elections as the form of participation, limiting it to a competition of voter votes. The economic theory of democracy, backed by the economic analysis of law, in a marginalist and neoliberal view of the economy, devoid of ethical content and based on homo oeconomicus, starts to dictate the model of contemporary democracy, in which government decisions must follow the dictates of the economy and the market, implying fundamental rights at risk as they cease to be realized in the name of economic efficiency. This modality of democracy, promoted by the current Brazilian government, as a democracy of efficiency, was practically implemented with the enactment of Constitutional Amendment 95/2016, by instituting a 20-year freeze on investments in social areas, such as health, education and social assistance, as a form of contingency of public spending, with the adoption of a strict fiscal adjustment. These measures, as reflected in the realization of fundamental social rights, these being included as stony clauses, in the norm of art. 60, § 4, IV, of the Federal Constitution, imply a violation of these clauses, as well as impose an obvious social retrogression, in clear violation of the principle of the prohibition of social retrogression, implicitly recognized by the Brazilian constitutional order. T herefore, as a counter to this retrocession implemented by the referred Amendment, there must be a constitutional interpretation committed to the constitutional identity, which is the guarantor of fundamental rights, including social ones, which must be placed in the sphere of the undecidable, safe from majorities, preventing them from being reached, under penalty of unconstitutionality.
